Our Responsible Lending Obligations
Under the NCCP Act, we are obliged to ensure that any loan or increase to a loan we arrange for you is suitable to your needs and objectives. To assess this, we will ask you questions to:
- Make reasonable enquiries about your requirements and objectives
- Make reasonable enquiries about your financial situation
- Take reasonable steps to verify that financial situation
It's important that the information you give us is complete, accurate and current — if you're unable to provide the information needed to assess your circumstances, we may not be able to make a recommendation to you.
Credit will be considered unsuitable if, at the time of assessment, it's likely that at the time credit is provided:
- You could not pay, or could only pay with substantial hardship; or
- The credit would not meet your requirements and objectives.
For example, if you could only repay by selling your principal place of residence, the loan is presumed to cause substantial hardship unless proven otherwise. You can request a copy of our preliminary credit assessment of your application within 7 years of when we assist you.
If we arrange a loan to purchase or refinance real estate, you must make your own enquiries about the value of that property and its future prospects. Any valuation we obtain is for our own use — you should not rely on it.
Acting in Your Best Interests
When providing credit assistance, we are obliged to act in your best interests (the Best Interests Duty). Any product we recommend must be in your best interests, and our reasons for that recommendation will be documented, recorded, explained, and provided to you.
If an actual, potential, or perceived conflict of interest arises, we will disclose it to you and prioritise your interests ahead of our own — including in situations where we know, or reasonably ought to know, there is a conflict between your interests and ours or a third party's.
Fees Payable by You
BLSSA Pty Ltd, as the licensee, does not charge you for credit assistance — we are paid commission by the financier. Your Credit Representative may charge a fee in some circumstances; if so, this will be disclosed to you in writing (a Credit Quote) before you proceed. You may separately need to pay the lender's application fee, valuation fees, or other third-party fees, which will be communicated to you when credit assistance is provided.
Commissions Received by Us
We may receive commissions from the lenders who provide finance for our clients. These are not fees payable by you. Commission percentages vary but generally range between 0.60% and 0.75% of the loan amount. Full details of the nature and amount of any commission relevant to your loan will be provided to you, and you can request further information at any time.
Commissions Payable by Us
We source referrals from a range of sources and may pay referral fees to call centre companies, real estate agents, accountants, or lawyers for referring clients to us. These referral fees are in line with usual business practice and are not payable by you. Details of the nature and amount of any such fee can be provided on request.
Our Internal Dispute Resolution
We hope you're happy with our service, but if you have a complaint, please contact Tanuj Kapoor directly in the first instance on 0452 512 003 or tanuj@jabsonsfinance.com.au. You can raise a complaint verbally or in writing, and we'll attempt to resolve it promptly. If your complaint can't be resolved directly, or will take longer than 30 days, contact BLSSA's Internal Complaints Officer using the details in the Key Information table above.
Our External Dispute Resolution
If we can't reach an agreement on your complaint, you may refer it to our External Dispute Resolution scheme, the Australian Financial Complaints Authority (AFCA) — a no-cost, independent service (contact details above).
